Whilst we will flag changes on the Website and/or send emails in relation to major changes, it is your responsibility to check the Terms for changes. General

These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as swim-pool , to the buyer hereafter referred as the Customer.

Price

The prices of the goods will be as quoted on the Website from time to time. We ensure that the prices of goods are correct at the time when the product was entered onto the system.

Prices for our goods may change from time to time, but changes will not affect any order which we have confirmed.

All prices are quoted in GB Pound Sterling and  at the applicable current rate chargeable in the UK.

The Website contains a huge number of products. It is possible that, despite our efforts, some of the products may be incorrectly priced. If we discover an error in the price of the product(s) you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect (lower) price.

Payment

Payments must be made in GB Pounds Sterling only, and by one of the following payment methods unless otherwise specified.

Orders

All Orders are subject to acceptance and availability. Upon placing an Order with swim-poo;t, the Customer will receive an order acknowledgement and subsequent update email(s).

Acceptance

The Customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 14 days after their receipt the Customer shall have notified the seller in writing or by email that the goods are rejected (this does not however affect the customer's statutory rights). If no such action has been taken, swim-pooll consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date

Returns Procedure

Swim-pool will not accept any returned goods should the return not follow the aforementioned return procedure.

Items can only be returned for a refund if they are unopened, unused and in a re-saleable condition with all tamper-resistant seals, packaging and any cellophane intact and must be returned within 14days of despatch.

In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. The Customer must notify swim-poo; within 14days of purchase and return the product toswim-pool before the refund or replacement can be issued. We will examine the returned product and will notify you of your refund within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 14 days of the day the return is received at Beauty Outlet and we confirm to you that you were entitled to a refund for the defective product. Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.

In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a partial refund (full refund of the goods less any postage costs), unless the order is cancelled within the cooling off period, in which case a full refund will be given. However, the Customer will be responsible for the cost of returning the item to Beauty Outlet. Goods must be returned to Beauty Outlet before the partial refund can be issued.

Cancellations

Cancellations which are not due to a defect or discrepancy are only accepted if the Customer complies with the following cancellation procedure and the follows the Returns Procedure.

Within 14 days after receipt of the goods, the Customer must contact swim-pool in writing via the contact details below. The goods must be 'as new' and unused, in original undamaged packaging, including all items and free gifts received. It is the Customer's responsibility to take reasonable care of the products until their return to swim-pool. Swim-poolt will consider that the Customer has not taken reasonable care if the goods have been used in a way or extent, exceeding what a customer would similarly examine the goods in a retail shop prior to purchase.

Our Liability

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract.

We only supply the products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not in any way exclude or limit our liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation;

defective products under the Consumer Rights Act 2015.

As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
